{"id":16717,"date":"2022-11-29T19:58:36","date_gmt":"2022-11-29T19:58:36","guid":{"rendered":"https:\/\/fieldnation.com\/?p=16717"},"modified":"2024-09-13T10:28:00","modified_gmt":"2024-09-13T15:28:00","slug":"misclassification-state-level","status":"publish","type":"post","link":"https:\/\/fieldnation.com\/resources\/misclassification-state-level","title":{"rendered":"Misclassification and regulatory changes on the state level (and what they mean for service companies)"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">In September 2020, <\/span><a href=\"https:\/\/www.goldbergsegalla.com\/news-and-knowledge\/knowledge\/californias-ab-2257-changes-state-independent-contractor-law\"><span style=\"font-weight: 400;\">California signed into law Assembly Bill 2257<\/span><\/a><span style=\"font-weight: 400;\"> (formerly AB5), which restricted the classification of an independent contractor to those individuals able to meet all three requirements of an \u201cABC\u201d test.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the law, in order for a worker to be classified as an independent contractor, they must:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A) Be free from the control of the company they are working for,<\/span><\/p>\n<p><span style=\"font-weight: 400;\">B) Perform work that\u2019s outside the course of the company\u2019s usual business, and<\/span><\/p>\n<p><span style=\"font-weight: 400;\">C) Have their own independently established trade, occupation, or business.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Like California, other states have developed their own nuanced versions of this ABC test.\u00a0 The following are some of the states that have passed their own versions of ABC legislation, all of which closely resemble the California law:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/esd.wa.gov\/employer-taxes\/independent-contractors\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Washington<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.nj.gov\/labor\/ea\/audit\/independent-contractor-vs-employees\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">New Jersey<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.mass.gov\/service-details\/independent-contractors\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Massachusetts<\/span><\/a><\/li>\n<\/ul>\n<a name=\"tips-for-navigating-the-changing-regulatory-environment\" class=\"fldn-table-of-contents-anchor\"><\/a><h1 id=\"tips-for-navigating-the-changing-regulatory-environment\"><b>Tips for navigating the changing regulatory environment<\/b><\/h1>\n<p><span style=\"font-weight: 400;\">As the regulatory environment continues to evolve, here are some DO\u2019s and DON&#8217;Ts to guide your usage of independent contractors through a platform like Field Nation:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>DO specify a clear beginning and end date for any project<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>DO have a well-defined scope of work for any contract assignment<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>DO pay contractors on time and offer a fair and competitive rate<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><b>DON\u2019T post assignments that are 40+ hours per week with set hours<\/b><\/li>\n<li aria-level=\"1\"><b>DON\u2019T post long-term assignments that last consecutive weeks or months<\/b><\/li>\n<li><b>DON\u2019T require providers to work exclusively with you without the ability to do other work<\/b><\/li>\n<li><b>DON\u2019T provide training on how to do a job in its entirety<\/b><\/li>\n<li><b>DON\u2019T provide all the tools necessary to complete the job<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">New regulations are an opportunity to assess your risk.
